Messaging service terms
Short version
If you send messages using WBS Services, be nice to other people. If someone uses WBS Services to send nasty things to you, do tell us, but please don't blame us.
An introduction
Warwick Business School (hereafter 'WBS') offers a number of messaging/email services (hereafter 'WBS Services') both free of charge, and paid for, to private individuals. WBS encourages and facilitates communication between users. These Terms of Use (hereafter 'Terms') form a contract to help to promote trust and understanding between you and other users of the WBS web sites. As a condition of your participation, you agree to abide by these Terms. By using WBS Services, you are accepting these Terms. If you do not agree, please leave the web site.
Please help us keep the WBS web sites an enjoyable experience for everyone. If you observe material or behaviour that may violate these Terms, please contact us.
Acceptable use
Individuals, organizations and businesses who can be legally bound by the terms and conditions described hereunder and enforceable under applicable law, are free to use the WBS Services for any lawful, worthy and ethical purpose, except as limited by these Terms. WBS Services must not be used to solicit customers or sell products or services. Furthermore, no more than 2000 uses of the WBS Services may be made by any one person, organization or business in any one calendar year without prior written permission from WBS.
You may use an automated program (robot or spider) to visit the WBS web sites. However, you are prohibited from using automated programs to use the WBS Services without prior written permission from WBS.
Identification
You must use appropriate names and language in the name spaces, address spaces and other spaces (if any) provided on the web site. You are forbidden from using false e-mail addresses. In addition, you may not use the WBS Services to send messages to or on behalf of people or other entities on mailing lists that you do not have full rights to use, nor send messages to people or other entities with whom you are not acquainted.
Modification and limitation
WBS reserves the right to modify these Terms at any time and without prior notice. We may add to, change, delete or end our or your use of the WBS Services at any time. The WBS Services may be temporarily unavailable from time to time for maintenance or other reasons. WBS Services, like all Internet media, rely on third parties for transmission and delivery of services. WBS cannot guarantee the provision of third-party services.
WBS does not assume responsibility for the content or context of the WBS Services and will not remove or edit the written content of messages once they are entered into the WBS Services, except if required by law or regulation, to expire records, or in our sole discretion. WBS web sites are venues only and WBS does not screen or censor or otherwise control the content offered to you by other participants.
Illegal materials
WBS prohibits the transmission, distribution or posting of material which violates any applicable laws or regulations. This includes without limitation any unauthorized use of material protected by patent, copyright, trademark or other intellectual property right, material that is obscene, defamatory or libellous, constitutes an illegal threat, or violates rights of privacy or publicity, or violates export control laws.
Staff and students of the University of Warwick must also comply with the regulations governing use of University Computing Facilities.
Offensive materials
WBS prohibits the transmission, distribution or posting of unwanted or offensive content. Prohibited transmissions include without limitation, profane or sexually explicit advertisements that include masking or misspelling the words, or images that would be illegal in any jurisdiction, including but not limited to the use of any variation of the WBS identity or name to display profane, illegal or explicit language or material, sexual or otherwise. It is your responsibility, and you agree to comply with all requirements, legal or other.
Unsolicited advertisements and offers
WBS prohibits the transmission, distribution or posting of unsolicited advertisements and offers. This includes without limitation, make-money fast schemes, pyramid or chain letters, fraudulent or criminal offers including but not limited to registering another email address other than your own, any posting with the goal of harassment of another, sexual requests from or for a minor, racial slurs or comments, harassment, placing a fraudulent ad, unsolicited advertising (whether commercial or informational) and unsolicited email or advertisements including 'spam'.
Private information
WBS prohibits the transmission, distribution or posting of any matter which discloses personal or private information concerning any person or entity. This includes without limitation phone numbers or addresses, credit or debit cards or similar financial information, user account numbers, passwords, home phone numbers or addresses, except where explicit permission has been obtained. WBS itself abides by the terms of an explicit Privacy Policy.
Waiver
In the event of breach of these Terms by WBS or any user of WBS Services, you waive your right to any damages (from any party) related to such exposure.
In the event that you have a dispute with one or more users of the WBS web sites, you hereby release WBS, its employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or WBS Services.
